Chapter 13 Bankruptcy — Making a Reorganization Plan
The goal of Chapter 13 bankruptcy is to reorganize what you owe, and provide a reasonable repayment plan that you can afford for your debt. It can also be used to stop mortgage foreclosure, motor vehicle repossession and bullying collections efforts of all kinds during your case. Moreover, if you can keep up with the current payments, you should be able to keep your home and your vehicle.

Chapter 13 bankruptcy is sometimes called the "wage earner" bankruptcy because it is typically used by people that have a steady source of income, but whose income is insufficient to keep up with their existing debts and obligations.
Generally speaking, in a Chapter 13 filing an individual's debts are consolidated allowing the individual to make payments based on what he or she can afford. A plan is created to make these payments for between three and five years. After that time, if all of the payments have been made according to the plan, some of the existing debts may be discharged as they would have been in a Chapter 7 bankruptcy.
Like a Chapter 7 filing, a Chapter 13 filing includes an "automatic stay" that prevents foreclosure and repossession efforts and bars creditor collection efforts and harassment.
Don't give in to "quick fix" strategies that could only make matters worse. Payday loans, 401(k) loans or withdrawals, home equity loans, reverse mortgages and the heavily-advertised debt consolidation approaches are generally not in your best interests. Let bankruptcy lawyer Nels C. Hansen use the proven features of Chapter 13 bankruptcy to help you rediscover financial freedom.
